These Terms and Conditions ('Terms') constitute a legally binding agreement between you and E-Voja (Pty) Ltd, governing your access to and use of the E-Voja mobile application, website, and related services. Please read these Terms carefully before using our services.
1. Eligibility
1.1 You must be at least 18 years old and capable of entering into a legally binding agreement to use the E-Voja platform.
1.2 By registering an account, you represent and warrant that all information provided is accurate, current, and complete.
1.3 You are responsible for safeguarding your login credentials and all activities conducted under your account.
2. Use of the Service
2.1 E-Voja grants you a limited, non-exclusive, non-transferable license to use the platform for booking or providing transportation services.
2.2 You agree not to use the platform for any unlawful or prohibited activities, including but not limited to:
- Impersonating another person or misrepresenting your identity
- Using automated scripts to access the platform
- Interfering with or disrupting the platform or servers
2.3 E-Voja reserves the right to suspend or terminate accounts violating these Terms or applicable laws.
3. Booking, Pricing & Payments
3.1 By confirming a ride request, you agree to pay the fare calculated using our dynamic pricing model.
3.2 Fares include a base fare, per kilometre and per minute rates, and may be adjusted due to regional pricing or surge demand.
3.3 You authorize E-Voja to automatically charge your preferred payment method upon trip completion.
3.4 You are responsible for ensuring that payment details are valid and up to date.
4. Cancellation Policy
4.1 Passengers may cancel rides, subject to a cancellation fee as indicated in the pricing model.
4.2 If a driver is en route or has arrived, a cancellation fee will be charged.
4.3 Repeated cancellations may result in account suspension.
4.4 Drivers may cancel trips for valid reasons, such as safety concerns or incorrect pickup locations.
5. Conduct & Safety
5.1 Riders and drivers must behave respectfully and lawfully during all interactions.
5.2 Harassment, discrimination, verbal or physical abuse, and illegal activities are strictly prohibited.
5.3 E-Voja may permanently deactivate users involved in safety incidents or misconduct.
5.4 Drivers must comply with traffic laws and maintain valid licenses, permits, and insurance.
6. Platform Access and Availability
6.1 E-Voja strives to ensure the platform is available 24/7 but does not guarantee uninterrupted access.
6.2 The platform may be unavailable during maintenance, software updates, or outages beyond our control.
6.3 E-Voja shall not be liable for service interruptions or delays due to such events.
7. Limitation of Liability
7.1 E-Voja is not liable for indirect, incidental, or consequential damages resulting from your use of the platform.
7.2 We do not guarantee the availability, safety, or reliability of drivers or vehicles.
7.3 E-Voja does not accept liability for lost or damaged items during rides. Users are encouraged to contact support for assistance.
8. Dispute Resolution
8.1 In case of a dispute, users should first contact E-Voja customer support.
8.2 If not resolved, disputes may be referred to mediation or arbitration in accordance with South
African law.
8.3 Legal proceedings will be conducted in a competent court within the Republic of South Africa.
9. Modification of Terms
9.1 E-Voja reserves the right to amend these Terms at any time.
9.2 Updated versions will be published on the app and website.
9.3 Continued use of the platform after modifications constitutes acceptance of the revised Terms.
10. Governing Law
10.1 These Terms are governed by the laws of the Republic of South Africa.
10.2 Any legal disputes shall be resolved in the courts of South Africa.
